Terms of Service

Effective Date: July 24, 2026. Please read these terms carefully before accessing or using ShiftGuard monitoring services.

1. Agreement to Terms

By creating an account, authenticating via Google OAuth, or accessing the ShiftGuard application, you agree to be bound by these Terms of Service and all applicable laws and regulations.

ShiftGuard is owned and operated by Ferrowright Engineering. If you do not agree with any of these terms, you are prohibited from using or accessing this site and services.

2. Critical Compliance & Liability Disclaimer

Know Your Compliance Responsibilities

ShiftGuard is a utility designed to help you monitor and document environmental conditions. It is NOT a legal certification of OSHA or state safety compliance.

Federal, state, and municipal heat index and wildfire particulate rules fluctuate and vary by region. ShiftGuard is a tool to support your recordkeeping efforts, but the employer holds final responsibility to ensure physical worker safety, distribute water/shade/respirators, and establish appropriate work/rest regimens.

Ferrowright Engineering and ShiftGuard assume no liability for regulatory citations, fines, or worker health outcomes resulting from your on-site operational decisions.

3. Account Registration & Google OAuth

Users are required to register an account using a valid email/password or via Google OAuth (Sign-In with Google).

  • You agree to provide true, accurate, and current information.
  • You are responsible for securing your login credentials and tracking access key sessions.
  • You must notify us immediately if you suspect unauthorized access to your company dashboard.

4. Subscription Plans, Billing & Paddle MoR

Subscriptions & Site Limits

ShiftGuard offers a Pilot Free plan (limited to 1 job site) and two paid plans (Starter and Growth plans) supporting larger numbers of active coordinates.

Merchant of Record (Paddle)

Our order process and subscription management are conducted by our Merchant of Record, Paddle.com. Paddle handles customer inquiries, payment processing, checkout validation, and tax compliance.

Subscribers can manage credit cards, review payment history, or cancel recurring subscriptions at any time via the Paddle Customer Portal link embedded in our billing panel.

5. Environmental Data & Third-Party API Limits

Our system relies on public weather and air quality APIs, specifically the National Weather Service (api.weather.gov) and the EPA AirNow API (airnowapi.org).

Because these are external government databases, ShiftGuard cannot guarantee 100% real-time data availability. Network outages, system downtime, or rate-limiting on government endpoints may cause temporary delays in environmental updates.

Alert notifications are dispatched via SMTP (Resend). We are not responsible for alert delivery failures caused by recipient spam filters, invalid phone/email inputs, or mobile carrier delivery limitations.

6. Termination of Service

We reserve the right to suspend or terminate account access and site monitoring for:

  • Failure to pay outstanding subscription invoices.
  • Violation of these terms or misuse of site geocoding queries (e.g. bulk coordinate script queries).
  • Request by the organization owner for account closure.

7. Govering Law & Support Contact

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
